Liability Insurance Claims: Key Facts & Tips

We’ve shared helpful tips and important information below about what to expect when you make a liability insurance claim to help ensure the claims process is as easy as possible.

We understand that liability claims may be complex and our Claims Advisers are here to help. We’ve managed over 19,000 claims in the past year and take great pride in providing our clients with expert advice from our experienced claims advisers to get the best possible outcome with every claim we handle.

Liability insurance cover is triggered when you are legally responsible for what has happened. Please contact your Rothbury broker immediately if:

  • You have caused damage to someone else’s property.
  • You have been contacted by another person or party holding you liable for an event causing damage.

It’s important to remember that there is a significant difference between feeling morally obligated to pay for costs to the impacted party and actually being legally liable for the costs. Insurance only covers you when you are legally liable.

  • When dealing with a liability insurance claim, it is important to not make any representation in terms of liability. If you do accept liability and your insurance provider believes that you are not liable, you could be left having to pay the costs yourself.
  • It’s best to leave your insurance provider and the other person’s insurance provider to discuss and negotiate the claim.
  • Your insurance provider will consider all the circumstances surrounding the loss. They look at what a reasonable person would have done in the same situation and then provide an opinion on whether or not the incident you are claiming for is something that you may be legally liable for or not.
  • If there is damage to someone else’s property, the owner of that property should contact their own insurance provider for advice and management of any repairs or reinstatement. The other person involved may be asked to pay an excess which could be reimbursed back when the claim is finalised.
  • If the other person involved does not have insurance, or cannot claim, they may be asked to complete a declaration form to confirm this. In this situation, your insurance provider will communicate directly with them.
